Right of Withdrawal

Consumers have a right of withdrawal for contracts regarding the delivery of goods in accordance with the following provisions.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without providing any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item.

To exercise your right of withdrawal, you must inform us (Jan Künster, Gudenauer Weg 75, 53127 Bonn, Germany, Tel: +49 228 282961, Email: info@jankuenster.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter or email). You can use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the withdrawal right before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including the costs of delivery (with the exception of any additional costs arising from you choosing a method of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return the goods without undue delay and in any case no later than fourteen days from the day you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way that was not necessary to examine the nature, characteristics, and functioning of the goods.

Exclusion or Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

• for the delivery of goods that are not pre-manufactured and for whose production an individual choice or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

The right of withdrawal does not apply to consumers who, at the time of the contract conclusion, are not residents of a Member State of the European Union and whose sole place of residence and delivery address at the time of the contract conclusion is outside the European Union.

If you finance this contract with a loan and later withdraw from the contract, you will no longer be bound by the loan agreement as well, provided that both contracts form an economic unit. This is assumed, in particular, if we are also your lender or if your lender uses our involvement for financing. If the loan has already been received by us upon the effectiveness of the withdrawal or upon the return of the goods, your lender will take on our rights and obligations under the financed contract with respect to the legal consequences of the withdrawal or return. This does not apply if the contract concerns the purchase of financial instruments (e.g., securities, currencies, or derivatives). If you wish to avoid contractual binding as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you have a right of withdrawal for that as well.
